Terms of Service

1. Acceptance of Terms

By accessing or using NearNature (“NearNature,” “we,” “us,” or “our”), including our website, applications, and services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Description of Service

NearNature provides location discovery, mapping, filters, and AI-powered itinerary planning tools. Some features are free, while others require a paid subscription and/or the use of credits.

We may modify, suspend, or discontinue features at any time, including changing credit costs or plan features.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality and security of your account and for all activity that occurs under your account.

4. Subscriptions & Credits

Certain features require a paid subscription. Subscriptions may include a monthly allocation of credits. Credits are used for premium features such as AI itinerary generation and storage.

Important: Credits do not roll over month-to-month. Unused credits expire at the end of each billing period. Credits have no cash value, cannot be transferred, and cannot be redeemed for money.

You acknowledge that NearNature may adjust credit amounts, credit costs, and plan features over time.

5. User Content

You retain ownership of the content you upload, such as photos or notes. By uploading content, you grant NearNature a non-exclusive, royalty-free license to store, display, and process that content solely to provide and improve the Service.

6. Prohibited Use

You agree not to:

  • Use the Service for unlawful purposes
  • Scrape, copy, reverse engineer, or exploit NearNature datasets, content, or systems
  • Attempt to bypass subscription limits, credit gating, authentication, or access controls
  • Interfere with system performance, security, or availability

7. Disclaimer of Warranties

The Service is provided “as is” and “as available.” NearNature makes no warranties regarding accuracy, reliability, availability, or suitability of locations, routes, itineraries, or recommendations.

Outdoor activities involve inherent risks. You are solely responsible for your safety, preparation, supervision, and decisions made using the Service.

8. Limitation of Liability

To the maximum extent permitted by law, NearNature shall not be liable for indirect, incidental, special, consequential, or punitive damages, including personal injury, lost data, lost profits, or business interruption.

9. Termination

We may suspend or terminate access for violations of these Terms. You may cancel your account at any time.

10. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

12. Data Sources and Attribution

NearNature utilizes geographic and location-based data derived from OpenStreetMap, which is made available under the Open Database License (ODbL).

OpenStreetMap data is © OpenStreetMap contributors. NearNature may modify, enhance, and curate this data to improve usability and user experience.

While NearNature strives for accuracy, all data is provided "as is" without warranty of any kind, and users should independently verify locations and details.

Privacy Policy

1. Information We Collect

We may collect the following information when you use NearNature:

  • Account Information: such as name and email address.
  • Usage Data: such as features used, pages viewed, and credits consumed.
  • Location-Based Queries: places you search for or filter. NearNature does not require continuous background tracking.
  • User Content: photos, notes, and other content you choose to upload or save.
Payments: Payment processing is handled by third-party providers such as Stripe. NearNature does not store full payment card numbers.

2. How We Use Information

We use information to:

  • Provide and improve the Service
  • Generate itineraries and recommendations you request
  • Manage subscriptions and credits
  • Communicate updates, support, and important notices

3. Data Sharing

We do not sell personal data.

We may share data with trusted service providers to operate NearNature, such as:

  • Cloud and hosting providers, such as AWS
  • Mapping and location APIs, such as Google Maps Platform
  • Payment processors, such as Stripe

Refund & Cancellation Policy

Subscriptions

  • Subscriptions are billed in advance on a recurring basis, such as monthly.
  • You may cancel at any time through your account settings or subscription portal, if provided.
  • Cancellation stops future billing but does not refund the current billing period.

Credits

Credits do not roll over month-to-month. Unused credits expire at the end of each billing period. Credits have no cash value, cannot be transferred, and cannot be redeemed for money.
  • Credits are consumed at the time a feature is used, such as itinerary generation or premium storage actions.
  • Used credits are non-refundable.

Refunds

Refunds are generally not provided, except in limited circumstances such as:

  • Duplicate charges or billing errors
  • Service outages that prevent core paid functionality for a meaningful period
  • Where required by applicable law

If a refund is approved, it will be issued to the original payment method.
